These Terms of Service ("Terms") govern your access to and use of the Appkitekt AI platform, websites, APIs, and related services (collectively, the "Service") operated by Appkitekt AI ("Appkitekt AI", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials, all activity under your account, and for ensuring that any team members you invite comply with these Terms.
2. The Service
Appkitekt AI is an AI Agent Optimization platform that audits, monitors, and helps you improve how AI agents discover, evaluate, and interact with your brand and apps. The Service relies on third-party AI models, search providers, and data sources; availability, output, and accuracy may vary and may change without notice.
3. Beta & Alpha Features
Features labelled alpha, beta, preview, or experimental are provided "as is", may be unstable, may change or be removed, and may produce inaccurate results. You should not rely on them for critical decisions.
4. Acceptable Use
You agree to our Acceptable Use Policy. In short: no illegal use, no scraping of others' private data, no attempts to break, overload, or reverse-engineer the Service, and no use to build a competing offering.
5. Your Content & Data
You retain ownership of the domains, URLs, prompts, and content you submit ("Customer Content"). You grant APPKITEKT a worldwide, non-exclusive license to process Customer Content solely to provide, secure, and improve the Service. You represent that you have the rights to submit it.
6. AI Output
The Service generates analyses, scores, recommendations, and other AI-generated output ("Output"). Output may be inaccurate, incomplete, or biased. You are responsible for evaluating Output before relying on it and for ensuring its use complies with applicable law and third-party rights.
7. Fees & Billing
Paid plans, credits, and subscriptions are billed through our payment processor. Charges are non-refundable except where required by law. Taxes are your responsibility unless we are required to collect them.
8. Third-Party Services
The Service integrates with third-party providers (e.g. authentication, payments, AI model providers, search and SEO data providers, hosting). Your use of those services is subject to their own terms. We are not responsible for third-party services.
9. Intellectual Property
The Service, including software, design, models, prompts, scoring methodologies, documentation, and trademarks, is owned by APPKITEKT or its licensors and is protected by intellectual property laws. No rights are granted except as expressly set out in these Terms.
10. Confidentiality
Non-public information disclosed by either party, including methodology, scores, roadmap, and pricing, is confidential and must be protected with reasonable care and used only to exercise rights and perform obligations under these Terms.
11. Suspension & Termination
We may suspend or terminate your access at any time for breach of these Terms, risk to the Service or other users, or non-payment. You may stop using the Service at any time. Sections that by their nature should survive will survive termination.
12. Disclaimers
THE SERVICE AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPKITEKT'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.
14. Indemnification
You agree to indemnify and hold APPKITEKT harmless from claims arising from your Customer Content, your use of the Service, or your breach of these Terms.
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance.
16. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which APPKITEKT is established, excluding its conflict-of-laws rules. Disputes will be brought exclusively in the competent courts of that jurisdiction, unless mandatory consumer law provides otherwise.
